Zofran Lawsuits

Zofran Lawsuits

Prescribed by doctors to pregnant women for the treatment of morning sickness, vomiting and nausea during pregnancy, Zofran has received many legal claims by patient and their families for fatal complications used by this drug. Numbers of Zofran lawsuits have been filed against the Zofran manufacturers GlaxoSmithKline (GSK), pharmaceutical giant based in US (Having estimated revenue of $35 Billion per year) for failing to adequately warn the pregnant ladies about side effects and injury caused after using dangerous drug Zafron while promoting its benefits.

Mothers, families and children who have been injured by Zofran use and have birth defects such as congenital malformations have taken manufacturer GlaxoSmithKline to court for marketing the drug to ladies during pregnancy without the approval of FDA (Food & Drug Administration).

Department of Justice (DOP) announced the settlement charge against GSK in 2012 for inadequate marketing of drug to physicians to be used for pregnant women suffering with vomiting and nausea as well as pay kickbacks for the use of this medication. To release from the allegations, GSK has to pay $3 billion in civil and criminal fines as part of settlement.

Despite of this settlement, Glaxo has not been released from lawsuits for complications, side effects or damage caused by the use of Zofran. Mothers having a child born with birth defects after using Zofran are eligible to file a lawsuit against the drug makers to get compensation for lost wages, medical costs and sufferings.

U.S FDA approves Zofran to cure cancer patients with nausea after surgery or treatment. The people who get sick after taking post-op meds to take cure for other complications or starts vomiting as a side effect from chemotherapy get treatment after using this medication.

Reasons for Filling Zofran Lawsuits

  • Despite of knowing that Zofran cause many complications and risks to developing babies because it passes through human placenta, Glaxo market the drug to pregnant women without adequately warning them about dangerous side effects.
  • Glaxo failed to determine the safety risks and warn the public about its side effects before promoting it to the public.
  • Glaxo market the Zofran as a safe treatment to pregnant ladies for morning sickness, nausea, vomiting and hyperemesis gravidarum even it was not approved by FDA for ladies during pregnancy.
  • In reality animal studies show that this drug was not safe because it show signs of toxicity and abnormal growth of bone. Despite of knowing this, Glaxo misrepresent the studies showing Zofran safe for the treatment.
